Deviations in colour, structure, workmanship, dimensions, design and details are reserved. Reserved are further incorrect information due to technical defects in our shop system or false information from our suppliers.

Territorial Validity of our Offers and Prices

All prices are strictly net and include value-added tax in the case of delivery prices and shipping charges. Our offers are valid in the United Kingdom. For electronic appliances, an adapter is included in all prices. The indicated delivery prices and shipping charges shall not apply to any orders with delivery addresses at remote locations. For such orders, please inquire about our conditions of shipment or delivery. We shall be happy to make you a favorable offer.

Conclusion of Contract: The products and prices listed in the online shop are regarded as an offer. However, this offer is subject to the condition that the contract may be voided if delivery proves impossible or if the price is incorrect.

Vouchers and Promotional Campaign

If not otherwise specified, a voucher is only redeemable in our shop at beliani.co.uk for products and does not apply to delivery charges or additional services. Vouchers can only be used for one order and cannot be exchanged for cash/gift cards or used in conjunction with any other voucher or promotional code. The remaining value of not-redeemed vouchers is not refundable and cannot be converted into cash. Vouchers cannot be used against previous orders and are only valid for promotional offers while stock last. The resale of the voucher requires Beliani's consent.

Delivery

We deliver our goods within the specified delivery times according to the item description on our website with the exception of unexpected circumstances we cannot be held responsible for. All shipping companies deliver Monday - Friday only.

There is no right to compensation in the event of delay of delivery as well as not delivering the goods within set delivery dates.

If you have ordered no additional service, such as Home Delivery or Assembly, delivery is only up to the curbside, maximum to where the forwarder can come with his vehicle. Deliveries on islands, in traffic-free zones or in non-truck-capable roads are not possible. The purchased product is assembled on-site (excluding whirlpools, bathroom cabinets, electrical installations and filling the waterbed). The installation of storage items and lamps on walls and ceilings is not included.

The customer is responsible for ensuring safe and adequate access conditions for delivery, including clear and passable access routes, functioning lifts or stairwells where applicable, and any information relevant to the safe execution of the delivery. The company is not liable for damages resulting from undisclosed or unsafe access conditions beyond the reasonable control of the delivery team.

Since this additional service has to be planned with external partners, the delivery time can be extended by up to 2 weeks. The customer is obliged to help to carry the products inside if their weight exceeds 60 kg. Note that this service may not be available on some parts of the country. Beliani takes no responsibility for any damage caused by the transport service provider.When it comes to deliveries of granite plates the customer needs to help the driver to carry it. Small items are delivered to your home, free of charge.Beliani takes no responsibility for any damage caused by the transport service provider.

Please remember that at the customer's request, the cardboard box can be disposed of by the transporter during assembly. However, if you wish to return the furniture, all products must be disassembled, provided in the original box and made ready for pickup on the curb. Some products are delivered to the customer directly from the producer on the disposable palette. A disposable palette, which as in the case of cardboard and other packaging should be removed by the customer at his own cost. The delivery company does only collect reusable pallets.

Deadlines and time frames provided refer to working days, not calendar days.

Certain products are shipped from the manufacturer to the consumer with a disposable pallet for one-time transportation. The disposable pallet is part of the consignment and must be disposed of by the consignee at their own expense together with the carton and other packaging material, unless otherwise agreed. Shipping companies only take reusable pallets.

If the Customer wishes that the ordered goods are still delivered and stored in their absence, this will be honoured at the Customer's risk. In case of loss or damage of this unacknowledged shipment (s), the Customer will not make claims of any kind against neither the delivery company nor Beliani. The Customer is aware that a claim of the sender for the payment of the consignments delivered in this form remains in place and valid in case of loss or damage. The revocation of this agreement must be made in writing immediately.

If the customer is not at home or unable to receive the order, it is considered delivered when it is left on the customer's doorstep. We are allowed to leave it there if we receive no response after attempting to contact the customer.

When requesting assembly services, the customer is responsible for providing a room with enough space to ensure a safe and efficient assembly of furniture. The room should be well-lit and well-ventilated, ensuring the air is free from harmful substances. The customer or their authorised representative must be present at the site during the assembly process.

Assembly and Access Conditions

When requesting assembly services, the customer is responsible for providing a room with enough space. The room should be suitable for safe handling. Customers are advised to secure floors, walls, and personal belongings prior to delivery. The delivery team will exercise reasonable care during the delivery process. Customers must inform the company in advance about any difficult access conditions, including narrow staircases, limited elevator access, or restricted entrances. If access requirements are not met, services may be cancelled.

If the delivery includes additional services, such as assembly, placement in the designated room, or disposal of old furniture, the delivery time may take longer compared to a standard delivery. The customer is required to provide a parking space for the delivery vehicle in proximity to the delivery address. A lack of adequate parking space may result in the cancellation of additional services, and delivery will then be made only to the curb.

If a confirmed delivery attempt is unsuccessful due to circumstances on the customer's part, the customer must cover the cost of the next delivery. In case of order cancellation, the customer will cover the cost of the first delivery.

If the confirmed delivery does not take place due to the absence of the customer or their authorised representative at the delivery address, the customer is responsible for covering the re-delivery costs, including all applicable fees, such as additional services if purchased. In the case of order cancellation, additional service fees are non-refundable.

If the delivery attempt fails due to unavailable parking, insufficient access roads, or failure to meet installation requirements, the customer will be responsible for the cost of a re-delivery. In case of order cancellation, the customer will be liable for the first delivery cost, and any additional services purchased will not be refunded.

Shipping Conditions

In most cases, the Buyer will be contacted by the shipping company to agree on the delivery date. For shipments that are advised, the recipient is obliged to be on site at the agreed time. In the absence of the recipient, the Customer accepts the cost of re-delivery, or collection of the goods, depending on the country, after the return request.

Alternatively, the consignee may also instruct the delivery of the furniture to a neighbour or to deposit it in front of the entrance without a signature. For this a written storage authorization is required, in advance by email or to be communicated during a phone call to Customer Service.

Upon delivery, in the event that the packaging shows damage, the recipient should check all items for any damage with the driver. If the driver does not agree to stay, we recommend refusing to accept the shipment and the Buyer needs to notify us immediately.

If a customer wishes to postpone the delivery date after the goods have already been sent to the local depot, additional storage fees may apply.

If the recipient decides to accept the damaged consignment, this must be reported to the deliverer and the recipient has to have the damage acknowledged or confirmed in writing on the scanner (please specify the damage). Transportation damage, which was not recorded by the deliverer at the Customer's request upon acceptance of the goods, will not be accepted as a valid claim. Any claims of the Buyer in this regard will be rejected.

Property and Retention of Title

The purchase agreement between Beliani and you as a Customer comes into existence at the time and day on which you have accepted the terms and conditions on our website and have placed an order. As a Customer, you accept as evidence the logged content of our website. You will receive an email with your order confirmation as confirmation of the purchase and with information regarding your billing and delivery address and contact details. The presentation of the products on the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the button "Send order" you submit a non-binding order of the goods you have chosen and put into the shopping cart. The confirmation of the receipt of your order is made together with the acceptance of the order immediately after placing it by automated emails. With this email confirmation the purchase contract comes to existence. The property of the goods is transferred to the Buyer upon delivery of the goods ordered.

Until full payment of the purchase price is received, the goods remain the property of Beliani. The latter is entitled, at the expense of the Buyer, to arrange for entry in the register of retention of title, if it considers its claim to be in jeopardy.

We save the contract text and send you the order data by email. The terms and conditions can be viewed at any time on the website of Beliani. Past orders can be viewed in your Customer account.

Beliani reserves the ownership of the purchased item(s) until full payment of the invoice amount. Should you be an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve the ownership of the object of sale until the settlement of all outstanding claims arising from the business relationship with the purchaser. The corresponding security rights are transferable to third parties.

You are only entitled to set-off if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.

If the Customer has any payment obligations, all existing claims will become due immediately.

Complaints, Warranty and Returns

Our products have a 2-year warranty. The guarantee period commences on the day of delivery. Any complaints shall be made as soon as possible after the receipt of the goods. Any defects emerging at a later date, i.e. during the warranty period, shall be reported immediately after their discovery. Complete information about the damage, including evidence, must be collected and presented to Beliani by the Buyer within 7 days of reporting the issue.

To claim the warranty the Buyer is obligated to show the sales document.

Customers can submit a complaint themselves using the "My Orders" feature available in the My Account section of the website. Alternatively, they can submit a complaint by telephone by contacting customer service.

Any damage resulting from wear and tear, ageing or improper handling shall be excluded from the warranty. Minor damages are defined as any damages not noticeable with a bare eye in natural lighting conditions from the distance of 3 meters standing diagonally to a damaged product. In case of minor damages, any claims against the Seller are unfounded. The warranty shall expire if the goods have been processed or altered despite recognisable defects. Our furniture is intended solely for private, personal and non-commercial use. The guarantee does not cover any damages resulting from any kind of commercial application.

Defects shall be rectified by Beliani free of charge unless Beliani prefers to provide faultless goods by way of replacement. Any further claims shall be excluded. For defects that are not covered by the warranty of Beliani, the buyer will receive a suitable offer.

All the services (payment fees, home delivery, installation, etc.) are excluded from the refund. In the case of technical products or built-in appliances, the customer has to identify the faulty part himself or ask a qualified technician to do so, and send the item to us.

The warranty expires if the whirlpool or bath is not installed by an authorized and qualified specialist. The work report should be presented on request.

If the furniture to be collected is not prepared as agreed, or if the room is not adequately prepared and accessible for collection or delivery, and this results in a failed service attempt, the refund for the service may be rejected.

The costs related to the diagnosis of the defect and the replacement of parts shall be covered by the customer. Warranty is a parts only warranty unless otherwise stated. Any installation costs to correct any issues will not be covered by Beliani. For warranty claims or damage reports, we will require photographic or electronic media evidence of the damage or proof to confirm the report of issues.

Mattresses Warranty

Because we strongly believe in the high quality of our mattresses, we give a 2- year warranty. The warranty covers defects related to the mattress design and construction. Applies to private use only. The warranty covers the following defects:

• springs in spring mattress
• filling in foam mattress
• filling in a latex mattress
• the electric motor in electric, adjustable bed (a two-year warranty)

The warranty does not apply to the mattress pad and topper. Furthermore, it does not cover defects related to inappropriate use e.g. splitting, tears, sagging, scratches, and stains caused by the buyer after the product delivery. In such cases, the warranty does not apply. The warranty is also not applicable to any defects resulting from improper use, bad assembly, lack of maintenance or incidental and consequential damages. The warranty does not apply in case of improper repair attempts, alteration or customization by an unauthorised person. The warranty does not cover zippers, handles and moulding of the product. Repair or replacement of the product does not change the warranty duration. The warranty is only valid if the correct bed frame was used for the product. In the case of a pocket mattress with flexible cold foam or latex mattress, the bed frame should have at least 26 slats. The client must send the product at their own expense to our warehouse for damage evaluation. If the product is withdrawn from sale by that time, Beliani decides on a proper replacement.

Returns

In accordance with consumer law, the buyer may withdraw from the purchase contract within 14 days of receipt of the goods without giving any reason.

Up to 14 days from the delivery date, a customer can return ordered items for free (exceptions apply). We will offer a free return and issue a full refund in the same method as your original payment. The exception for free return up to 14 days includes orders with original packaging missing, orders of bathtubs, whirlpools, hot tubs, as well as custom made products. In these cases, a customer bears transportation costs.

Please note that depending on the terms, the return cost, which will be deducted from the order value, is calculated based on the return shipping cost applicable to the original dispatch warehouse. This warehouse may differ from the address listed on our Returns page.

Beliani will pick up goods free of charge from UK mainland only (UK mainland excluding northern parts of Scotland - Highlands and Scottish Isles and Northern Ireland). Additional fees are to be charged in case of returns from abroad. Including all islands.

Once the collection of the goods is agreed upon, the customer has 14 days to facilitate the pickup. After this period, the right to a full refund will no longer apply.

After 14 days, a customer needs to cover the return cost. Refund will be issued in the form of a voucher to be used at beliani.co.uk within 360 days. Excluded from returns after 14 days are bathtubs, whirlpools and hot tubs, as well as custom made products. We only accept returns of products that have not been used, assembled, installed or damaged. We will accept returns of products repacked securely in the original packaging.

In order to withdraw from the sales contract, the buyer has to provide Beliani with a declaration within 14 days of receipt of the goods. The buyer then receives the ticket number, which must be attached to the returned goods. Returns without this number will not be accepted.

Unpaid parcels will not be accepted.

The goods must be packaged in such a way that they can be transported and be ready for return transport on the curbside. If the original packaging is not available, the customer must provide suitable alternative packaging himself so that the product is adequately protected during transport. The buyer should take a photo of the shipment before sending it back and send the photos to Beliani.

If the returned item is in a different condition after the assessment than the item originally sent to the recipient, e.g. mechanical damage caused during assembly or dismantling or signs of wear, we reserve the right to charge the costs for spare parts or depreciation of the item caused by damage deduct.

After receipt of the goods, the buyer receives his money back within 7 days using the same payment method as he paid himself. Unless a different method of payment is agreed with the buyer, but without hidden additional costs for Beliani.

Please note that the refund amount will be reduced by the value of the promoted voucher or product in the event of a return. The first exchange or return of the products that have been partially or fully paid for with a voucher is free of charge. In the event of more than one exchange or return, products must be returned at the Buyer's expense.

Business Customers
If the order is cancelled at any stage or the goods are returned, the customer will bear the operating costs.

Transportation Risks, Damages and Transport Insurance

Transportation is at the risk of the customer but is partially covered by transport insurance. The customer is required to immediately inspect the received goods for accuracy, completeness, and integrity. Any damage to the received goods must be reported as soon as possible, no later than 24 hours after delivery, via the customer panel in the section My Account, using the Report a Problem option. The original packaging must be kept by the customer in case of a claim, it should only be disposed of after written confirmation from us.

Reporting any visible transport damage within this timeframe supports a timely investigation with the carrier. This does not affect the customer's statutory consumer rights. Failure to report the damage within the 24-hour deadline may limit the customer's ability to make a claim.

At the end of the order process, the client can optionally purchase a transport warranty, it may cover any loss and damage during transportation. A transportation warranty covers damage and loss during the transport up to the value of the goods at the time of ordering. The customer can only get a repair, exchange (new delivery) or financial compensation up to the value of the goods. The decision to repair, exchange or financial compensation can be decided only by Beliani.

Repairs carried out by the customer without consent from us can not be further processed in the warranty.

The buyer should dispose of damaged items at his own expense, in agreement with Beliani.

In the event that a product is received with transportation damage not documented by the customer and confirmed by the shipping company (in Proof Of Delivery), we reserve the right to charge the customer for return shipment costs.

Necessary Attachments in Case of Complaints and Transportation Damage

Short and precise description of the problem and detailed description of the damage with pictures of the affected areas / defects (meaningful detail photos), photos of the complete product and photos of the packaging in which the products were delivered (damage to the box and the photo of the print where the part number and order number is visible).

In case of transportation damage - a copy of the proof of delivery stating the condition of the goods upon the delivery, with the signature of the delivery agent. Alternatively, if the driver has acknowledged the damage on an electronic device, a confirmation that the shipment has been acknowledged as damaged.

Information about expectations of the Buyer, e.g. Repair, replacement of the product, price reduction or return and full refund.

Until the complaint is resolved, please keep the packaging in case it is needed to return the goods.

In the event of damage in transit, it is necessary to have the damage acknowledged by the deliverer upon acceptance of the shipment. Please kindly note the damage on the delivery note and request the signature from the driver. You can then upload a copy of the signed document via the customer portal in the My Account section of our website. If there is no confirmation from the driver that the consignment was damaged at the time of delivery, we will assume that the consignment did not show any visible defects during the delivery. In such cases, neither Beliani nor the manufacturer will be held responsible for the damage. Any claims of the Buyer in this regard will be rejected. Beliani is obliged to answer the Buyer's request as soon as possible, at the latest within 14 days after the notification of the claim. The Buyer's claim will be sent to the email address provided by the Buyer.

Up to 365 days Return Policy

Your satisfaction is of the greatest importance to us. If the ordered items do not meet your expectations or preferences, we provide you with the possibility of 365 days for product returns. Below you will find all details concerning our Return Policy:

The Effects of Return / Return Consequences

In the case of an effective return, the services received on both sides must be returned and any benefits derived must be surrendered.
