RULES OF THE COMPETITION "Bella Ciao Sing-Off"

§ 1. GENERAL PROVISIONS

1.1. The organizer of the Facebook competition (hereinafter referred to as the "Competition") is the company

Beliani GmbH, based in Lindenstrasse 16 6341 Baar, Switzerland,

NIP: PL5263092611 (hereinafter referred to as the "Organizer").

1.2. The organizer is the founder of the award.

1.3. Providing personal data is voluntary, but necessary for the Participant to enter the Competition. Participants providing data have the right to access this data, change it or delete it.

1.4. The contest is not created, administered or sponsored by Facebook. Facebook is a registered trademark of Meta, Inc.

1.5. The competition is run on https://www.facebook.com/beliani.co.uk  (hereinafter referred to as "Fanpage") at the URL: https://www.facebook.com/beliani.co.uk 

§ 2. TERMS OF PARTICIPATION

2.1. The competition is open to any age group, however children below the age of 18, can only participate with the consent of their legal guardian.

2.2. Employees and associates of the Organizer may not participate in the Competition.

2.3. The participant may submit any number of songs.

2.4. In the case of group submissions, only one participant may receive the award.

2.5. To take part in the Competition, the Participant should:

a) during the period referred to in the section. 2.6 participants should add a video of them (or other parties) singing Beliani theme song “Bella Ciao” to the Facebook post comment section.

2.6. The competition runs from 25.09.2022 to 30.09.2022. The winner is the video with the highest number of likes and it will be announced on Beliani’s social media platforms on 3.10.2022.

2.7. The organizer is not responsible for the temporary or permanent blocking of the Facebook page or application.

§ 3. AWARD

3.1. The prize in the Competition is a 450£ voucher (1st place) and 100£ (2nd and 3rd place), to be used in official Beliani shops. The voucher can not be combined with other codes.

3.2. The Winners are not entitled to exchange the prize for cash or any other type of prize. 

3.3 The Winner may waive the prize, but will not be entitled to a cash equivalent or any other prize in return.

§ 4. PRINCIPLES OF AWARDING PRIZES

4.1. 1 Winner is selected for the Competition.

4.2. The prizes in the Competition are awarded within the time limit specified in section 2.6 of the Regulations

4.3. The Competition winner is selected by the highest number of likes

4.4. The Competition winner will be notified of the win and the Prize collection terms via a private message sent to the profile using which the Participant sent the Competition Drawing.

4.5. In the notifying message, the Organizer asks for the data necessary to send the Prize.

4.6. The Prize will be delivered to the Winner at the Organizer’s expense by post, delivered within the United Kingdom.

4.7. To receive the Prize, the Winner should return the address and telephone number of the recipient of the prize within 7 days from the date of receiving the win notification.

4.8. In the event of failure to meet the aforementioned deadline, the prize will not be sent.

4.9. The Organizer has the right to publish the Winner's details on the Fanpage.

4.10. The prize will be sent to the address indicated by the Winner within 30 days from the date of sending the address details.

4.11. The Organizer is not responsible for the inability to transfer the prize for reasons attributable to the Participant, and in particular in the event of failure to provide or incorrect data of the Participant, about which the Organizer was not informed. In this case, the prize is forfeit.

4.12. In the event of detecting activities inconsistent with the Regulations, attempts to influence the selection of the Winner unlawfully, in particular by setting up fictitious profiles on Facebook, the given Participant may be excluded from the Competition.

§ 5. COMPLAINTS

5.1. Any complaints regarding the manner of conducting the Competition should be submitted by the Participants in writing during the Competition, but not later than within 14 days from the date of the Prizes.

5.2. A written complaint should contain the name, surname, and exact address of the Participant and a detailed description and justification of the complaint. The complaint should be submitted in writing or in a form of an e-mail to the address of the Organizer.

5.3. Complaints will be considered within 30 days.

§ 6. FINAL PROVISIONS

6.1. The prizes to which the participants lost their rights for the reasons specified in these regulations remain at the disposal of the Organizer.

6.2. Disputes related to and arising from the Competition will be resolved by a common court competent for the seat of the Organizer.

6.3. The Organizer reserves the right to change the rules of the Competition during its duration. Information about the changes will be posted on the Fanpage. 

§ 7. COPYRIGHTS

7.1 You are granting us the following rights of use, free of charge, unlimited by content, time or territory

7.2 To use, edit and modify your Work for comprehensive use on our websites and accounts, including for the purposes of commercial marketing. This grant of rights expressly includes all known and unknown forms of Internet offerings

7.3 The unlimited right to reproduce, make publicly accessible, and publicly display your Work, in particular through the digital integration of your image on our accounts and websites

7.4 The advertising rights, i.e. the right to use your Work for advertising Beliani and products offered by Beliani on our websites and in all other media, including outside the Internet

7.5 The right to make publicly accessible; that is, the right to store the Work and make it accessible and ready to view by the public, whether in analogue or digital form

7.6 The right to use your Work in connection with other work.
